ETHICAL-LEGAL QUESTIONS LIVED BY PROFESSIONALS OF A MUNICIPAL HEALTH SERVICE – INDAGATIONS AND PROPOSITIONS

This is an descriptive and exploratory research with a qualitative approach realized in health unities of a municipal service. The data were obtained through interviews with physicians, nursing and odontology professionals. It presents a reflection about the importance of health professionals preparation, members of a multiprofessional team, to assume respective parcel of responsibility when face a fact that involves questions referents to applicable ethic and legislation in theirs professional practices. The data were analyzed using as base the theoretical reference of the civilian responsibility and subjective elements of guilt – unskilfulness, imprudence and negligence. Among the aspects identified we observed how diversified are the situations that involve health professional in questions that need ethical and legal knowledge and how much the preparation is deficient during the professional formation about the theme studied, pointed in 80% of the answers. We aim with the present study to provide subsidies to next researches, considering that the processes involving civilian responsibility of health professionals are more and more often.
