Crisis in the separation of powers theory and hybrid institutions in the context of Latin American constitutionalism: the institutional role of Argentina's Anticorruption Bureau

The constitutional transformations in Latin American constitutionalism are marked by the coexistence of hyperpresidentialist structures with the emergence of institutions responsible for developing best practices of democratic governance in a context of crisis in the separation of powers theory. Argentina's institutional design in the fight against corruption provides a paradigmatic case in which the concentration of power in the executive branch clashes with the oversight role of the Anti-Corruption Bureau. For the analysis, the research was developed in distinct phases. In the first stage, the approach used was critical-analytical and structural, exploring the abstract-theoretical field from the comparative method. In the second stage, the empirical investigation of the Anti-Corruption Bureau was carried out, evaluating the performance of the institution in the dynamics of the Argentine political system. Finally, based on the evaluations obtained, institutional paths were indicated to restructure the Anti-Corruption Bureau in order to impact its performance and raise it to the level of a hybrid institution according to the proposed premises. Among the results achieved, we highlight that the Anti-Corruption Office, due to its structure, is not aligned with the assumptions of autonomy, independence, transparency and effectiveness of hybrid institutions, requiring reforms.
