STATE, EDUCATIONAL POLICY AND RIGHT TO EDUCATION IN BRAZIL: "THE BIGGEST PROBLEM IS TO STUDY”.

The article analyzes the historical constitution of the inequities in guaranteeing the right to education for that access, permanence and quality. Discusses the progress of the right to education in the field of legal rationality (normative system) but emphasizes the need to overcome major challenges to the enforcement of this right in the field in political rationality, as if we have a legal definition on the issue social responsibility of education (citizen's right and duty of the state), there is still a long way for the distribution of social representations associated with understanding and effective - in politics, management and educational organization - the meaning of values such as law, equality and inclusion. From this analysis, the article indicates that, on the one hand, education is now proclaimed as a civil right and duty of the state and are, according to official discourse, very close to universal access in basic education, on the other hand, social representations are very far from the promises of emancipation that underlie the right to education.
