Abstract

Analisa conceitos do multiculturalismo e do pluralismo jurídico. Interpreta o tratamento dado aos povos indígenas pela Constituição brasileira de 1988 e pela Convenção n.º 169 da OIT. Analisa exemplos prático-jurídicos acerca da efetivação do direito dos povos indígenas ao reconhecimento.

Graduado em Direito pela Universidade Estadual de Londrina e Mestrando em Filosofia e Teoria do
Direito pelo Curso de Pós-Graduação em Direito da Universidade Federal de Santa Catarina. Bolsista
da CAPES. A primeira versão deste artigo, um tanto quanto maior do que esta, foi apresentada como
requisito para a aprovação na disciplina “Pluralismo Jurídico”, ministrada pelo Prof. Dr. Antônio Carlos
Wolkmer, durante o terceiro trimestre de 2004.
