Abstract

O presente artigo tem como objetivo contribuir para o debate existente em torno dodireito penal do inimigo, tendo como referência o contexto brasileiro de guerra contra o tráfico de drogas. Para isso, realiza uma breve análise do conceito e dos fundamentos do direito penal do inimigo e de sua incorporação na teoria de Sánchez como “terceira velocidade” do direito penal, identificando-o com o atual direito penal dirigido aos traficantes no Brasil. Em seguida, analisa algumas das críticas formuladas contra o direito penal do inimigo e, diante da verdadeira guerra travada contra os traficantes, propõe que se pense a questão do tráfico de drogas no Brasil a partir de uma nova perspectiva.
