NEW SLAVERY IN CONTEMPORARY BRAZIL: CRIME AND PUNISHMENT

In considering that there is nosimilarity between contemporary slave workand historical slave work, this article intendsto discuss two types of contemporary slavework: rural work and urban work, this latterconsidered from two perspectives such asslave work without valid labor contract andwork done in conditions of new-slavery butwith valid labor contract according tocurrent labor legislation. Then, this articleaims at showing that such working practicescan be described as criminal practicesaccording to the criminal legislation,particularly, article 149 of BrazilianCriminal Code so that in the realm of laborlaw the accused can be considered guiltand be obliged to repair the plaintiff forunlawful act.Downloads
