Dominant Players in Digital Platforms and the Risks to Copyright Protection and Competition Freedom: Is More Regulation Needed?

The aim of this paper is to analyse the role of the dominant player in digital platforms, in the context of the challenges that their strategic decisions present for freedom of competition in special cases involving copyrighted works. The converging regulatory framework in which these acts of market supply take place is presented, as well as the key concept of the dominant player. Starting with an enumeration of the effects of technological innovation on the platform’s business activity, some of the risks are identified and explained in consideration of the works and copyright involved. Subsequently, the possible ways to address this situation, which are studied from the point of view of doctrine and public policy, are put forward. Finally, personal reflections are formulated on whether regulation aimed at dominant players can be useful and what its scope would be.
