Abstract

A reforma agrária representa atualmente um programa constitucional, que confere obrigações à União e direitos subjetivos públicos aos cidadãos de vê-lo implementado. O regime jurídico da propriedade agrária tem seu fundamento na Constituição Federal de 1988. A análise das normas que disciplinam a produtividade do imóvel rural deve levar em consideração todo o sistema constitucional, e não apenas um ou outro dispositivo. Tomada em sua totalidade, a Constituição permite a harmonização das normas constantes dos artigos 184, 185, II, e 186, compatibilizando a disciplina da propriedade produtiva com a da função social. Desse modo, a interpretação constitucional leva a concluir que os elementos que constituem a função social da propriedade agrária o elemento econômico, o elemento ambiental e o elemento trabalhista, integram o conceito de propriedade produtiva. Propriedade produtiva é, pois, propriedade socialmente produtiva.
