Abstract

Procura-se fundamentar a defesa das ações afirmativas raciais mediante a compreensão complexa dos direitos humanos; a interpretação da História do Brasil em seu período de reorganização da economia, após o fim da escravidão; e a rejeição do dogma da igualdade formal como elemento capaz de concretizar os verdadeiros ideais da Constituição Federal. O conjunto de opressões implícitas e explícitas contra os afro-descentes gerou, dentre inúmeras conseqüências, a exclusão sistemática do negro do acesso ao mercado de trabalho e à educação formal. Adota-se uma hermenêutica constitucional para a construção e efetivação da igualdade substancial, por meio da defesa da legitimidade e da necessidade do estabelecimento das ações afirmativas, principalmente para o acesso de afrodescentes à educação superior pública e de qualidade.
