Abstract

O texto discute algumas questões relativas às mudanças jurídico-institucionais na utilização da pena de degredo no Brasil oitocentista, mais especificamente no período imperial, que o tornam diferenciado do degredo secular e inquisitorial praticado pelas justiças do Império Português durante todo o Antigo Regime, principalmente entre os séculos XIV e XVIII. Por meio do caso da degredada Maria Vieira, notamos aspectos de uma certa centralização e humanização penal da justiça luso-brasileira, reflexo das mudanças que ocorriam no contexto ocidental iluminista de fins do século XVIII e início do XIX. Assim sendo, discorremos sobre o reflexo e a adaptação dessas idéias na criação das três colônias de degredados brasileiras no século XIX e na aplicação da pena de degredo no mesmo período.
