This paper has the purpose toverify in what measure the work of theAmerican philosopher John Rawls can beunderstood as a Theory of Constitution, capable to be related to the categories ofjustice, liberty and democracy. To reach thatobjective, it is necessary to start with the firstconceptual approaches between theconstitutional discourse and the work of JohnRawls, with the methodological finality toprove the intuitive idea that the elements ofjustice are enough to understand the justiceas fairness as a Theory of Constitution, withvaluable contributions to the democraticconstitutionalism.
