Abstract

Exceptions and/or limitations for text and data mining (TDM) within the scope of intellectual property are essential for the development of artificial intelligence and for making the European Union (EU) market suitable for innovation and competitive facing other markets with more flexible solutions such as the US, Asia, and UK in the post-Brexit context. The Infosoc Directive has numerous flaws, as it failed to harmonize an exhaustive, inflexible, and outdated rage of exceptions and/ or limitations to copyright and related rights in all Member States of the EU. Text and data mining is more recent, and is not foreseen in this Directive, nor in the Directive on Databases or on Computer Programs and has been subject of different national solutions in the Member State. For all these reasons, it became clear, since 2015, that there was a need for the creation of a Directive that would suit the current digital market, in the context of a competitive Europe with cross-border solutions. Among many other important aspects, the Directive on copyright and related rights in the digital single market has established exceptions and limitations for the purposes of TDM in its articles 3 and 4. The analysis of exceptions and/or limitations for the effects of TDM has brought, alongside its advantages, various questions that remain unanswered and hence the purpose of our study
