The Implementation of DSM Directive’s Article 17 in Germany - Overview and Controversial Issues in the Regulation of Digital Platforms

Abstract

The new Directive on Copyright and Related Rights in the Digital Single Market will be implemented by the EU Member States in the coming months. The bill of law currently under discussion in Germany contains innovative and controversial proposals for the im-plementation of its Art. 17 regarding the liability of online content-sharing service providers for the com-munication to the public of protected works. In view of the political and economic relevance of the German regulation, this article analyzes the current version of this bill of law in detail, addressing its most sensitive aspects and identifying some inconsistencies. Through this, it is expected to contribute historically and aca-demically to the research in this field, which may be useful for the discussion on the modernization of the copyright law in other jurisdictions.
