Abstract

O principal objetivo do presente trabalho é instigar a discussão sobre a violência judicial que é instrumentalizada contra os movimentos populares de luta pelo acesso à terra e moradia no Estado do Paraná. Partindo de uma definição sociológica de violência, derivada da teoria de luta de classes marxista e das concepções arendtianas, o artigo discute quatro decisões dos órgãos judiciários paranaenses que instrumentalizam a violência da classe hegemônica contra os trabalhadores. Em seguida, investigam-se as classes sociais, que historicamente formam os quadros dos movimentos populares e do judiciário paranaense, por se tratar de elemento essencial para demonstração da ignorância da realidade social brasileira. Da existência de preferência de classe por alguns órgãos do judiciário estadual, que motivam muitos magistrados a acatar parcela dos comandos constitucionais e a pronunciar decisões inconstitucionais, ilegais ou ilícitas.
