DO ESTADO AO INDIVÍDUO REPENSANDO OS SUJEITOS DO DIREITO INTERNACIONAL PÚBLICO

O conceito de sujeito de direito é um dos elementos centrais dos ordenamentos jurídicos, na medida em que os contornos daquele determinam os pressupostos e os efeitos destes. O presente trabalho busca discutir essa noção no âmbito internacional, a partir de uma análise dos sujeitos tradicionais do Direito Internacional Público e da ascensão do indivíduo neste cenário. Procura-se, assim, verificar se esses entes possuem as capacidades básicas dos sujeitos de direito mediante o estudo de suas possibilidades de atuação nos fóruns e tribunais internacionais, no qual a pessoa humana é especialmente abordada. Ao final, objetiva-se delinear as condições para o desenvolvimento e o aprimoramento dessa atuação, o que poderia representar um salto de qualidade e de efetividade no próprio direito internacional público.
