Abstract

De acordo com a CDB (Convenção da Diversidade Biológica) e sua
previsão do CPI (Consentimento Prévio e Informado) como requisito essencial para
o acesso à biodiversidade, deve-se respeitar e resguardar os direitos das
sociedades tradicionais e repartir benefícios. Para isso, é primordial proceder as
mudanças no relacionamento e nos usos dos conhecimentos das sociedades
tradicionais. Neste cenário, as Instituições de Pesquisa devem buscar os
mecanismos de proteção do conhecimento para, com isso, evitar a dilapidação de
recursos seus, da comunidade e do País. Ao se adequarem às previsões legais,
efetivando-as em suas ações de pesquisa, somam-se ao processo de
(in)formação das sociedades tradicionais, contribuindo para sua sustentabilidade
e a do meio ambiente. Nesse aspecto, a efetivação da regra legal de acesso à
biodiversidade, e seu CPI, configura-se em instrumento de inclusão social e
acesso aos direitos humanos.
