Abstract

Os recentes avanços tecnológicos e o atual contexto socioeconômico não suportam os clássicos conceitos delineados para definir o que venha a ser propriedade intelectual. Portanto, é necessária uma revisitação de conceitos e do substrato teórico em que se insere o instituto. Por se propor a esta tarefa, este trabalho demonstra a inexatidão dos conceitos clássicos sobre propriedade intelectual e, após, traça um conceito cientificamente adequado para a mesma. Posteriormente, dedica-se a investigar as origens da tutela estatal à apropriação intelectual, definindo o contexto socioeconômico e tecnológico de sua ocorrência e excursa-se historicamente em acompanhamento à sua evolução. Por fim, evidencia-se a crise que hoje enfrentam os direitos de propriedade intelectual. Este esforço busca contribuir para o debate que, mesmo sem esperanças de encontrar solução conciliatória, é saudável para o aprimoramento científico do instituto.
