DIMENSÃO JURÍDICA E FORMAS DE APROPRIAÇÃO NO BRASIL

A realidade brasileira é determinada, durante todo o seu percurso histórico, pela progressiva mudança em relação às noções jurídicas envolvendo as relações de pertencimento entre o homem e a terra. O presente trabalho analisa, inicialmente, a “apropriação territorial” da Colônia mediante a implantação desajustada do regime jurídico português de concessão de terras denominado “sesmarias”. Além disso, procura refletir criticamente sobre o período histórico que ficou conhecido como “regime de posses”, no Brasil, e sobre o processo histórico envolvendo a elaboração e aplicação da “Lei das Terras” de 1850. Os debates parlamentares para fazer cessar o “regime de posses” e promulgar a “Lei das Terras”, em 1850, evidenciaram conflitos políticos e jurídicos permeados pelas concepções tradicional e moderna de propriedade. Observa-se, principalmente na segunda metade do século XIX, o embate entre as tentativas de instauração de uma concepção moderna de propriedade e o peso das tradições na política e na cultura jurídica brasileiras.
