O texto pretende fazer convergir a análise de um caso prático sobre a decadência e os pressupostos processuais, em particular da capacidade, com duas teorias sobre tais pressupostos com vistas a melhorar a compreensão do fenômeno processual. Sobre tais dois aspectos, a convergência permitirá investigar diversas consequências no nível do contexto de aplicação no desenvolvimento teórico processual que deem unidade sistemática a nossa área, comentando a respeito de como se resolveu um complexo caso por parte da justiça chilena.
