The subnational ecological constitution in Brazil: a brief analysis of the characteristics and processes of the Brazilian environmental constitutionality bloc

Subnational constitutionalism is a significant element in multilevel contexts, yet it remains underexplored in Brazilian specialized literature. This article aims to partially bridge this knowledge gap by examining the subnational ecological constitution in Brazil, identifying key aspects such as its scope, development, innovations, and the processes of vertical and horizontal circulation of constitutional models, as well as its susceptibility to abstract constitutional review. Employing quantitative, qualitative, and notably comparative methodologies, the study analyzes the subnational component of the Brazilian environmental constitutionality bloc, seeking to determine whether subnational constituents merely replicate federal models or enhance and develop them. After providing an overview and mapping these elements for contextualization, the article focuses particularly on subnational fauna protection and the recent “cascade effect” of a federal-originated backlash. Lastly, it explores judicial activity in environmental matters under state and federal concentrated review, emphasizing the “de-constitutionalizing” role of the Supreme Federal Court (STF, in Portuguese) regarding state constitutional norms on environmental issues. The article concludes that, in environmental matters, Brazilian subnational constitutional law is distinguished by its analytical and innovative character and by its greater propensity for horizontal model circulation processes. Furthermore, it highlights that the STF often acts as a veto player against subnational constitutional decisions in this area, demonstrating little self-restraint concerning subnational ordinary or constitutional legislators.
