Taking legal hermeneutics seriously

This study aims to contribute to Mexican legal dogmatics and contemporary legal hermeneutics regarding the problem of interpretation and its evolution within its framework, which has been thoroughly analyzed from philosophical hermeneutics, in its historical-effective path of correct understanding of the understood, through which it has been possible to demystify some topics of interpretation, such as the prejudice (Vorurteil) or the “historical distance,” and introduce new concepts such as the fusion of horizons; hermeneutical principles that, far from hindering or appearing as a disadvantage, make understanding itself possible. It is a study that aims to go beyond the traditional problem of hermeneutics that addresses types of interpretation, methods of interpretation, and the tradition in claris non fit interpretatio. Therefore, there is a projected need to practice with a historical consciousness that enables the development of the possibilities of understanding. In other terms, taking legal hermeneutics seriously.
