Reinterpreting the conservation of local knowledge in the legal framework for biodiversity

Abstract

Since 2015, the third objective of the Convention on Biological Diversity has been regulated in Brazil by Law No. 13,123/2015 and Decree No. 8,772/2016, which constitute the so-called legal framework for biodiversity (LFB). However, many criticisms have been directed at the LFB, especially regarding the valuation of the role of traditional knowledge in conserving species diversification. Given the change in perspective offered by the resilience of local knowledge, this study investigates the consequences for the Brazilian strategy of access and benefit-sharing (ABS) of biodiversity envisioned in the LFB, aiming to valorize and conserve traditional knowledge. Using a deductive method, a bibliographic and documentary research was carried out on the theoretical support component and the functioning of ABS. Findings reveal that, from the perspective of resilience, which favors a positive view of the interaction between knowledge systems, the dynamic nature of traditional knowledge is valued, understood as a process that encompasses a complex mixture of replication, loss, addition, and transformation. The contribution of this reinterpretation to ABS is to value hybridization with new knowledge and skills from external sources. However, this hybridization can also lead to the loss of authenticity and the unique and contextual characteristic of local knowledge, as well as generate increased inequality if the sharing of benefits from this integration is not equitable – aspects that are more directly related to ABS when the discovery of a certain usefulness of a genetic resource is made possible by access to traditional knowledge.
