The powers of exception of the president. Notes to contribute to their understanding, from the economic, social and ecological emergency generated by COVID-19 in Colombia

This article explores the main features and specificities of the state of economic, social and ecological emergency in the context of the 1991 Colombian Constitution, as an instrument that allows the accumulation of powers of rule-making and rule executing by the executive branch. Based on a quantitative analysis of the normative production enacted and developed by the Colombian Executive for solving the constitutional emergency derived from the COVID-19 pandemic, the article analyses risks for the separation of powers and of checks and balances principles in this concentration of powers. These risks are clear, especially due to the diversity of formulations used by the Colombian Executive Branch for determining validity terms of this legislation produced by the executive to deal with this constitutional emergency.
