Abstract

Nesta pesquisa relacionou-se o processo civil e direitos humanos em uma
perspectiva cultural atual, caracterizada pela ausência de ideologias hegemônicas. Considerouse
acerca da origem da ciência processual, questionando-se sobre os alicerces sob os quais
foi erguida. Na seqüência, adentrou-se no processo como mecanismo de realização das
diretrizes constitucionais, embasando a importância do relacionamento entre processo e
direitos fundamentais, por ser aquele instrumento para realização destes assim como ele, em
si mesmo, um direito desta categoria.
