The concept of Law in Axel Honneth’s Critical Theory: between recognition and social pathology

This article seeks to understand the transformations of the notion of Law (Recht) in Axel Honneth’s books The Struggle for Recognition (1992) and Freedom’s Right (2011). In other words, this study corresponds to a conceptual investigation on the role of Law in the reconstruction of social reality. The central hypothesis is that legal recognition, as a possible way of understanding social claims in modern democratic societies, fails to fulfill a central role of social emancipation throughout Honneth’s theory. First, the study places Honneth in the philosophical tradition of Critical Theory (Frankfurt School), in order to point out his methodological understanding of philosophical investigation based on the so-called “reconstructive method”. Then, the study develops a conceptual analysis on the notion of Law in Honneth’s two books, starting from the “subjective recognition patterns” in The Struggle for Recognition, and the subtopic about legal freedom in Freedom’s Right. Finally, the text concludes that Honneth not only understands the legal phenomenon in different ways throughout his major works, but, fundamentally, in opposite ways, especially regarding the sphere of the relationship between law, ethics and emancipation.
