Judicial application of law: The legal methodology applied by judges of the International Criminal Court

This article deals with the task of understanding the analysis of the methodological operations imposed on the judges of the International Criminal Court, which often function as “brake standards” for discretion and casuism. Because it is a treaty-based court that is an international organization, the traditional issues require some additional thought to understand how the methodology applied by these judges operates. Using as a starting point the six methodological operations, identified by Professor José Lamego, a Portuguese reference author in legal methodology, it will reflect on some of the issues arising from the decision-making process, namely the operationalization of the principle of separation of powers, the principle of legality and the manner in which judges apply the law, making use of international criminal doctrine and the Court’s decisions.
