Abstract

O presente trabalho busca analisar o modo como Stanley Fish lida com a aproximação entre Direito e literatura, tomando como fio condutor uma segunda relação, entre retórica e interpretação jurídica. Mediante um contraste entre a atividade do jurista e a do crítico literário, iremos observar a fragilidade das fronteiras que buscam separar rigorosamente esses dois domínios, sobretudo quando sustentadas em ideais científicos. Sem desconsiderar esse tipo de proposta, trataremos de ilustrar que tipos de considerações podem ser feitas ao Direito a partir de uma perspectiva diversa e mais próxima do domínio literário.
