Abstract

Este ensaio tem por objetivo elaborar problemas e hipóteses de pesquisa sobre a independência jurídica e política brasileira observada pela óptica da teoria do poder constituinte e da identidade do sujeito constitucional. Para tanto, procede a uma reconstrução breve da historiografia tradicional brasileira e dos textos escritos no campo da historiografia constitucional do país. Logo à frente, procura oferecer um panorama daquilo que vem sendo produzido nos últimos anos a partir de importantes releituras pelas quais tem passado a historiografia. Por fim, busca articular as ideias anteriormente desenvolvidas para formular problemas e hipóteses para trabalho futuros. Mais do que oferecer respostas, o texto preocupa-se, do início ao fim, em sofisticar perguntas e levantar dúvidas.

Marcelo Andrade Cattoni de Oliveira, UFMG

Mestre e Doutor em Direito (UFMG). Pós-doutorado em Teoria do Direito (Università degli studi di Roma Tre). Professor Associado II da Faculdade de Direito da UFMG. Professor do corpo permanente do Programa de Pós-Graduação em Direito da UFMG, linha de pesquisa História, Poder e Liberdade.

David Francisco Lopes Gomes, UFMG

Bacharel e mestrando em Direito (UFMG). Bolsista CAPES-REUNI junto ao Bacharelado em Ciências do Estado (UFMG).
