Abstract

Este estudo tem por objetivo comparar a concentração de atribuições legislativas eadministrativas nos sistemas federativos alemão, argentino, australiano, austríaco, suíço, brasileiro, indiano e norte-americano. Com base na   distribuição de competências legislativas entre a União e os Estados, pretende-se analisar o grau de restrições existentes ao poder central e o consequente grauautonomia normativa das subunidades. Serão consideradas as competências constitucionais quanto ao conteúdo (classificadas segundo a matéria) e quanto à extensão (classificadas segundo a participação um ou mais entes federativos),  conforme a técnica de repartição adotada  constitucionalmente. Constatase, desde já, que os modelos mais recentes de federação abordados  distanciam-se do modelo clássico norte-americano ao estabelecer menores restrições à capacidade normativa do governo central.
