Abstract

The necessity of law protection ofpersonal data, raised by the informationtechnologies, changed the concept of right toprivacy, that now on is understood as the right tocontrol the own information’s flows. Nevertheless, the law protection of privacy is still centered onindividual consent, with some exception justifiedby public interests. This model disregards theimportance of information in the distribution ofsocial power. And, in a society ready to renouncerights in the name of security and of the participationin the technological world, the market’s interestsand the State’s reasons end by prevailing.
