Soluções jurídicas em matéria de sustentabilidade ambiental no setor vitivinícola: uma comparação entre as experiências francesa e italiana

Resumo

A análise aqui apresentada corresponde à fase inicial de uma pesquisa desenvolvida no âmbito de um Projeto de Pesquisa de Relevante Interesse Nacional (PRIN), financiado pelo Plano Nacional de Recuperação e Resiliência (PNRR) da União Europeia — fundo Next Generation EU — e pelo Ministério da Universidade e da Pesquisa da Itália, sob a denominação Innovative solutions in the wine sector (IN-WINE). O objetivo deste estudo é identificar os instrumentos jurídicos adotados nos ordenamentos francês e italiano em apoio à sustentabilidade no setor vitivinícola, com atenção especial, neste caso, à sustentabilidade ambiental. Ao definir o escopo da pesquisa, também se considerou pertinente examinar, ainda que de forma breve, a normativa supranacional europeia, dada sua interação com a legislação nacional e a necessidade de contextualizar as escolhas realizadas em nível estatal. A análise evidencia uma colaboração significativa, voltada ao alcance das metas ambientais, entre os setores público e privado, que caracteriza o modelo decisório do setor vitivinícola tanto em nível europeu quanto nacional. Os resultados permitem identificar boas práticas exemplares que podem servir de guia metodológico para a ação pública, além de oferecer reflexões sobre possíveis perspectivas em matéria de sustentabilidade — não apenas ambiental — no setor vitivinícola.
