Abstract

The limitation on its duration is one of the fundamen-tal characteristics of the rights exercised over a patent. Any extension of the term stipulated beyond that pres-cribed by domestic and international laws should be thoroughly analyzed under penalty of violating the precepts of balance of interests that permeates the gran-ting of exclusive rights. In Brazil, the provision of the sole paragraph of article 40 of the industrial property law, which extends the term of validity of a patent in the event of delay in analyzing the application by the National Institute of Industrial Property (INPI), has caused doubts regarding its constitutional adequacy in the face of tension between public and private interes-ts. The Brazilian Supreme Court, when asked about the matter in Direct Action for Unconstitutionality No. 5529, is facing a strong dilemma regarding its institutional capacity to decide on a technically and politically complex matter. In this sense, we intend to analyze the performance of the Federal Supreme Court in light of the argument of institutional capacity, es-pecially after the injunction decision granted in the context of the pandemic caused by COVID-19 and the precedent of the court based on the lack of its insti-tutional capacity to resolve the dispute in an absolute manner. For this purpose, the hypothetical-deductive method is used, and as auxiliary research methods the qualitative approach, the documental and bibliogra-phical research technique, the theoretical procedure, and the descriptive and prescriptive research. The pre-liminary injunction decision has the power to impel or push the institutions capable of changing the scenario, such as the legislative power and the BPTO, to take the necessary actions to solve the factual problem and restore the constitutional balance of the patent system.
