The fight against piracy and counterfeiting: a strategy with limited reachs

Abstract

For half a century we have witnessed a widespread tendency to direct efforts towards harmonizing legis-lation and deepening intellectual property protection, justified in part by the apparent “damage” caused by counterfeiting and piracy. This trend focuses on the protection of private interests as a matter of general interest, disseminating figures that are not entirely proven, allowing the stigmatization of some of its effects. On the contrary, what is needed is a more ri-gorous analysis of the phenomenon. In addition, the measures recently adopted or contained in bilateral agreements (FTAs) and proposals in international law (ACTA), would be affecting and limiting public freedoms – obstacles to trade and access to culture and information – especially that which circulates on the web, leading to a limitation of creativity disproportio-nately in relation to the real impact of the phenome-non and its consequences.
