The “work” created by an autonomous artificial intelligence system: Reflections from post-anthropocentrism for Spanish Intellectual Property Law

Abstract

This study attempts to highlight the excessive anthropocentrism prevailing in the Law and defends giving space to other non-human entities that could become holders of rights and/or obligations. In this sense, the legal problems arise so that an artificial intelligence system can be considered an author, as well as that the result generated by it be qualified as a work. The need for a minimum creative height for a human work to be considered original must be questioned when it comes to assessing the originality of the work generated by an intelligent machine. By way of final reflections, it is proposed how the regulation of works generated by artificial intelligence systems could be addressed in Spanish intellectual property legislation.
