Art Market and Copyright: some challenges and perspect

Abstract

The aim of the present paper is to share some topics that are being discussed about the challenges of the art market in its relations with copyright. Thus, in a context of vindica-tion of the rights of visual artists, it highlights the need to improve the collective management of rights through effective tools for tracking, gathering and distribution of participation rights in the resale of works of visual arts, as well as the licensing of patrimonial rights in the digital environment. On the other hand, it points out the necessary training of the econo-mic agents involved in the commercialization of digital art, with a view, once the ownership of the rights has been determined, to optimize the income of the authors in terms of intellec-tual property rights, exclusive rights or remu-nerative rights, as well as the respect for their moral rights. In this last line, it has been poin-ted out that the growing importance of street art in the art market, due to its passage from the street to galleries, auction houses and mu-seums, requires greater attention to issues such as authorship, the exercise of the moral right to integrity or the limit on the use of the image of works located on the public highway.
