Thinking about “New Rights” in a Temporary Key: Towards a Test of Authenticity of Human Rights

The “new rights” are a phenomenon of our time, which responds to the evolutionary nature of human rights. This dynamic nature of human rights is observed, whether in the area of normative expansion or in that of interpretation. They thus try to respond to new needs, interests or circumstances. However, they are also a problematic phenomenon that can lead to their artificial proliferation. To this end, this article reflects on the legal implications of conceiving “new rights” and proposes an authenticity test based on the idea of time, in order to contribute to a better understanding of authentic human rights.
