Materialism and legal interpretation: some issues for legal theory

The main purpose of this article is to raise some questions regarding legal interpretation from a philosophically materialist perspective. One of the axes of the argument established in this work is to point out, with regard to legal interpretation, an excessive preoccupation with language by the theory of law, to the detriment of what this work calls material reality, or non-discursive domain. The article seeks to reinforce, rather than exclude, the Foucaultian distinction between the discursive and the non-discursive, in order to propose an approach to legal interpretation properly contextualized and rooted in concrete legal practices. Thus, it aims to raise theoretical reflections on the degree of intervention that theories on legal practices – including interpretation – have in the transformation of institutions and social relations, such as the realization of fundamental rights. It resorts mainly to the work of Manuel DeLanda, with the aim of delimiting a set of concepts that allow to think of a conception of legal interpretation that takes into account the materiality of social phenomena (the non-discursive).
