The discussion concerning thejuridical education must be done in the contextof the two big Copernicans revolutions thathave crossed the law and the philosophy inthe twentieth century: the constitutionalismand the ontologische Wendung (ontologicallinguisticturn). One denounces, thus, thatthe legal dogmatic remains refractory tothis paradigmatic disruption, carrying onreproducing a standardized juridical education,which contributes for the ineffectiveness of theConstitution. The philosophical hermeneuticcan be an important contribute for theconstruction of a speech able to overcome thetheoretical insufficiencies of the theoreticalcommon sense of jurist.Downloads
