Abstract

O artigo aborda a crise de legitimidade do sistema penal brasileiro, o qual não consegue cumprir com as finalidades para o qual foi instituído: a segurança jurídica. A Lei n.º 9.099/95, Lei dos Juizados Especiais Criminais, foi aprovada com vistas a uma política de despenalização dos crimes de menor potencial ofensivo, com vistas a substituir a pena privativa de liberdade por penas alternativas. Tenciona-se desafogar a Justiça Criminal, para que esta se preocupe efetivamente com o combate e a repressão da criminalidade grave, para a qual deverá ser mantido um eficiente sistema prisional e, ao mesmo tempo, adotar estratégias para superar a seletividade do sistema criminal, importante fator na crise de legitimidade do sistema penal e do Poder Judiciário em sua totalidade.
