O Lugar dos Direitos Humanos nas Democracias Contemporâneas (1945-2015)

O artigo discute, preliminarmente, qual é o lugar dos direitos humanos nas democracias contemporâneas, com o propósito de verificar se os direitos humanos estão presentes no ideal e na práxis democrática. O método de análise histórica utilizado evidencia o processo evolutivo dos direitos humanos e sua relação com a democracia, desde 1945 até a elaboração dos “novos” elementos essenciais dos regimes democráticos pela Comissão de Direitos Humanos das Nações Unidas (UNCHR) em 2002. Argumenta-se que os direitos humanos encontram-se muito mais na normatividade do que na prática política democrática, mas há uma crescente demanda pela devida aplicação das normas internacionais e leis nacionais de direitos humanos.
