International Norms and Behavior of States: The relationship between indigenous peoples and Brazil under the ILO Convention No. 169

The 20th century was marked by the flourishing and propagation of International Organizations. Despite the fact that this sort of organization already existed before, it was in the middle of that century that they began to spread in a larger scale and, therefore, to gain more relevance in the International System. Under the structuralist constructivism perspective, we observe how these organizations could affect the behavior of States. Thus, the objective of this paper is to make a brief analysis of the influence of the ILO Convention No. 169 on Indigenous and Tribal Peoples and the behavior of the Brazilian State. The research methods utilized are literature review and document analysis. For that, on the first section we discuss constructivism and the propagation of norms over the international environment. After that, we shed light on the creation of the ILO Convention No. 169. Finally, we analyze the internalization of the Convention by Brazil and the situation of indigenous peoples living in that country before their rights established on that instrument. We conclude discussing the fact that, although the norm has been internalized by the Brazilian State, its behavior indicates that it is not being fully complied with.
