Resumo

O presente trabalho tem como objetivo identificar se a regulação pública da violência conjugal contra a mulher, através da Lei Maria da Penha, confere com a demanda das vítimas que acionam o sistema judiciário. Sendo assim, buscou -se problematizar a efetividade da Lei 11.340/06 e o seu r ompimento total com a Lei 9.099/95, através de uma pesquisa na 4ª Vara Criminal do Fórum da Comarca de Santa Maria, RS. Os resultados indicaram que as vítimas parecem desacreditar que o sistema penal seja um instrumento efetivo para solucionar os conflitos de gênero.
