The performances created by Artificial Intelligence: the reflection of algorithms in digital resurrection

Abstract

This paper seeks to understand how the use of deepfake technology influences digital resurrection projects. These projects allow the digitally inserting of deceased actors in new works. deepfake is an artificial intelligence process in which the machine can combine materials to create new works. The combination of the two technologies can be seen in the exhibition Dalí Lives, where the artist was digitally recreated to interact with visitors to the museum. To achieve the purpose of this study, bibliographic references of a multidisciplinary, legislative and jurisprudential character, in Brazil and in the United States, are used as a method of study. The paper will then present the concepts of both technologies. It will then be discussed, how the copyright of interpreters are protected and how it will be affected in situations involving deepfakes. Finally, it will be analyzed how the ownership of intellectual works created by artificial intelligence applications might be treated in Brazilian laws. It is concluded that, in Brazil, the law does not provide for these types of situations, leaving ownership in these creations open for discussions, evidencing the need for a legislative adequacy to resolve any conflicts that may arise from the implementation of these technologies in the country.
