Amicus Curiae petition for the Claim of Non-Compliance with Fundamental Precept (ADPF) 442 on the possibility of abortion decriminalization

This is an amicus curiae petition submitted to the Brazilian Supreme Court by the Human Rights Clinic of the Federal University of Paraná (CDH|UFPR), in partnership with the Center for Studies on Human Rights Systems (NESIDH) and the Clinique du Droit of the University of Paris Nanterre (EUCLID), on the occasion of the Claim Of Non-Compliance With A Fundamental Precept (ADPF) n. 442, regarding the possibility of decriminalizing abortion in Brazil. The document reflects thorough research on the inadequacy of criminalizing abortion under the Inter-American System of Human Rights, as well as relates the panorama of abortion regulation in Europe and its compatibility with the right to life, based on a study provided by EUCLID. Finally, it concludes that the legal framework for legal abortion in Brazil can absorb the decriminalization of abortion up to the 12th week of pregnancy.
