Parental consent in school research and the Brazilian law

Abstract

One difficulty about research involving students is to obtain their parental consent. This paper analyzes types of parental consent used in research with students and reviews legal arguments on these issues. The Active Consent Term (ACT) means that one caretaker signs a document authorizing the child´s participation. The use of this Consent Form may reduce the number of research participants, diminishing sample randomization and, thus, raising the study´s cost. In contrast, in the Passive Consent Term if parents do not accept their children`s participation, they send researchers their signature expressing non-authorization. Brazilian law only authorizes ACT, because parents have the responsibility to decide what is best for their children. Future studies should discuss ethical implications of both terms´ usage.
