Powers, institutions, and norms: authority as the foundation of legal decisions

The article discusses the cause of the coexistence of divergent decisions in a legal system. It will be analyzed from the factual perspective of the courts’ actions. The article is based on John Searle’s institutional theory, addressing institutional facts, deontic powers, and the relationship between law and language. Legal language, being open and abstract, allows for a variety of possible applications. Decisions against the law are possible due to the diversity of interpretative criteria and the fact that decisions are primarily based on the authority of the judge. This is a qualitative research that uses deductive method.
