Abstract

An investigation into “the judicialization of politics and the politicization of the judiciary” restricted to the proper functioning of the “rule of law” would be prey to the damage that the very idea of the “State” entails, embodied in the theory that supports it, the theory of sovereignty. It is necessary to escape “state-centrism” and one of the ways to do so is to investigate the notions of “power” and “law”. In this article, we investigate these notions in Merleau-Ponty and Lefort.
