POR UMA OUTRA JUSTIÇA: DIREITO PENAL, ESTADO E SOCIEDADE

Resumo

As relações entre a sociedade e o Estado nas sociedades contemporâneas constituem o objetivo deste trabalho, em particular o papel do Direito e da Justiça penais. Adaptando uma perspectiva interdisciplinar (Filosofia, Sociologia e Antropologia jurídicas) e normativa, toma partido como uma possibilidade, sem excluir outras pela democratização da democracia, opondo, para tanto, a socialização do exercício do poder político à estatização da sociedade. Mais concretamente, apresenta a Ética do Outro em contraposição à Ética do Um, em que a primeira representa a alteridade, que deve ser incorporada em nossos padrões de conduta, e a outra representa o confinamento em nossos valores particularistas. Além disso, o Direito Penal é percebido como um locus privilegiado em que esses temas éticas do Outro e do Um, socialização do poder, estatização da sociedade aparecem relacionados e materializados.

TOWARD ANOTHER JUSTICE: PENAL LAW, STATE AND SOCIETY

Abstract

This paper looks at the relation between State and society in the contemporary world, focusing particularly on the role of Law and penal justice. Taking on a normative and interdisciplinary perspective (Philosophy, Sociology and Anthropology of Law), it takes a stand for the democratization of democracy, thus establishing an opposition between the socialization of the exercize of political power and the statization of society. More specifically, it opposes the Ethics of the Other to the Ethics of the One; the first represents alterity, which should be incorporated into our standards of behavior, while the latter represents confinement within particularist values. In addition to this, Penal Law is perceived as a privileged locus in which these themes the ethics of the Other and of the One, the socialization of power and the statization of society are related and become materialized.

POUR UNE AUTRE JUSTICE : DROIT PENAL, ETAT ET SOCIETE

Résumé

Les relations entre la société et lEtat dans les sociétés contemporaines constituent lobjectif de ce travail, particulièrement le rôle du Droit et de la Justice pénaux. En adaptant une perspective interdisciplinaire (Philosophie, Sociologie et Antropologie juridiques) et normative, il choisit comme une possibilité, sans en exclure dautres la démocratisation de la «démocracie», en opposant à cet effet la socialisation de lexercice du pouvoir politique à la «statisation» de la société. Plus précisément, il présente lEthique de lAutre opposé à lEthique de lUn, où la première représente laltérité qui doit être intégrée à nos modèles de conduite et lautre représente nos valeurs particulières où nous nous enfermons. En outre, le Droit Pénal est perçu comme un locus privilégié où ces thèmes éthiques de lAutre et de lUn, socialisation du pouvoir, statisation de la société sont en rapport et deviennent réalité.
