«Perils of the Sea»: Ibridazioni tra assicurazione marittima e Law of Nations nell’esperienza statunitense tra sette e ottocento

Resumo


RIASSUNTO: La ricostruzione in chiave storica delle complesse relazioni esistenti tra marine insurance e admiralty law nel contesto nord-americano durante il XIX secolo consente di far luce sul rapporto che lega lo ius gentium ad ambiti cruciali del diritto interno, quali il diritto commerciale e la disciplina del commercio internazionale. All’esito di tale indagine, gli Stati Uniti si rivelano uno dei contesti storici privilegiati per l’affermazione e lo sviluppo della teoria del primato del diritto internazionale. La tesi favorevole all’esistenza di un rapporto gerarchico-funzionale tra norme di diritto internazionale e norme di diritto interno trova, nella complessa vicenda storica esaminata, una significativa conferma.
