Il momento giuridico nella costruzione del ‘modello’ totalitario: Ernst Fraenkel, Franz Neumann, Hannah Arendt

Resumo

Il saggio prende in considerazione il contributo arrecato alla teoria del ‘totalitarismo’ da tre autorevoli esponenti dell’intellettualità europea costretta all’esilio dal regime nazionalsocialista: Fraenkel, Neumann e Arendt. Pur nella diversità del loro approccio, tutti e tre gli autori sostengono che le radicali trasformazioni cui lo Stato e il diritto vanno incontro nella Germania nazionalsocialista e nella Russia bolscevica sono un contrassegno decisivo del carattere ‘totalitario’ dei rispettivi regimi.
